My further leave to remain(FLR) as HSMP migrant will expire on 1st
December 2011 and then i will be eligible for indefinite leave(ILR),can now i apply Tier1 dependent visas for my family from out of UK because someone told me that the main applicant should have at least 6 months valid visa to apply visa for his/her dependents from outside UK but i have only less than 4 months valid visa now.

If main applicant's 6 months visa restriction is not applicable for applying dependents visa from pakistan then in case of refusal due to some reason which can be successfully contested in appeal what will be the status of their appeal because normaly appeals are decided in more than 6 months , but after 4 months my status will change and my FLR will convert into ILR. In that case will my dependents get visa through the same appeal or they will have to file new application with new visa fee as dependents of settled person.

Please guide me whether tier1 main applicant can apply visa for his/her dependants from outside UK if main applicant has less than 4 months valid visa.
