1-is spouse or civil partner should be EU citizen or UK citizen ?

OR could be from any country , whether she/he is on student visa in UK and

he/she called his/her civil partner under (320(7b) or not[/u]

320 (7C) applies to applications made under paragraph 281 or 295A. An application by a spouse of a person on a student visa would not be applying under 281 or 295A.
