HSMP Extension - False represntation/fraud offence

HSMP Extension - False represntation/fraud offence

My HSMP extension is due in March 2012 and I have got a 'false representation' offence.

I have been found guilty of false representation by Crown Court and have been given Community Service penalty of 300 Hours.

Please advise in which way is it going to effect my hsmp extension/ILR?

Should I start packing my luggage to go back home or would I be given hsmp extension?

Your conviction on the charge of fraud by false representation is a criminal conviction that must be declared in your T1(G) extension application. Such an unspent conviction does not constitute an automatic refusal, but a refusal on that ground is possible. It may be reasonably assumed that having further convictions, fines, penalties etc, on your list will not encourage the caseworkers to exercise discretion in your favour.

You will be ineligible for ILR until you are clear of any unspent convictions; at the moment, that means in five years' time.
