My first application(in-time-application) was invalidated with the HO promising refund due to increases in fees and the use of the right form which I was advised to reapply using the new form after their decision 2weeks by which time my visa has expired.
I put in a new application as I was advised and paid the new fees; biometric done after receiving letter. Then 6 weeks later I got a letter to send a further bank statement to back some of the days that my funds fell short of the £800 everyday requirement introduction???? I then wrote back explaning the criteria in place when I got my Tier1(general) 3yrs ago did not specify that but only enough funds especially over the 90-day period and more significantly at the date of the application was the criteria in place.
I also made refrences to the HO being in receipt of my previous fees which they promised to refund but failed to do so and pleaded for that to be taken into consideration and living in the country just over 8 years now.
However, the defendant in my case(caseworker) has come to a decision of refusing me now with no right of appeal????? Any advise?
Thinking of pursuing a Judicial Review...since I have no right of appeal even though they are still in receipt of paying my money for my first application!!!!! Can someone confirm why it is necessary to show proof of maintenance funds everyday for 90days when you are going for extention?????when originally the rules specified that proof of maintenance would be waived during extention????
