i need to apply PSW but my sti is complcated pls help

Post by flight55 » Wed Aug 10, 2011 9:39 pm

Hi everyone
my student visa had expired in november 2010. I applied for extension when i was in Uk but it got rejected with a right to appeal. I appeal to the first tier tribunal AND it got rejected as well and then i appealed to the higher tribunal. I was waiting for the hearing date. However, I did withdrawn the appeal to the upper tribunal and left UK. I will apply PSW visa from my home country now but im scared as I had a visa that run out during studies. Eventhough my stay in UK was legal after november, would my visa for PSW get rejected or approved? because one of the requirements to get PSW visa is ur immigration status in UK. if anyone could give me ideas, ill appreciate,

Thanks alot
Kind regards

post your dates here detailing EXACTLY youe history.

Be precise.

If you are deemed to have 'overstayed' for more than 28 days, you will attract a ban of 1 year automatically

Also, make sure its not more than 12 months since you got your degree!

@ arsenal : thanks alot for your reply
my visa expired on 30th November 2010

applied visa on 20th December 2010 to HO ( i applied for a visa type fot turkish nationals only and u can apply that type of visa within the 28 days of your visa expiry date I applied that one because i didnt want to risk it it was my final year of studies so if i applied for student visa they would have banned me and i wouldnt be able finish uni. it was a very stressful year but at least i finished now )
I heard from them (rejection ) on 2nd February 2011

I appealed to the first tribunal on 16th of May and then I heard from them on 6th of May (appeal was rejected too )

I made the appeal within 5 working days ( 12th of May ) to upper tribunal and I ve heard that thy approved and i was waiting for the hearing date but i did withdrawn it on 3rd august and left the country on the same day

so he is exact days I am wondering would they reject it as the visa expired on 30th november 2010 during studies eventhough my stay was legal. Because one of the requirement of PSW is ur immigration status

how would that affect me .

Many many thanks for ur concern

What special visa for Turkish nationals did you apply for exactly and why was it refused?

How did you get a right of appeal if you applied as an overstayer?

Hi Greene
It is called ECAA. There is rights of appeal if you have applied withing the 28 days of the visa expiry date.(in which I did ) It is for people who are willing to set a business or for ppl to work as an employee. The reason why I have applied that visa is because they give appeal right so that I can stay in the country and finish my course. as I have overstayed I wouldnt have had right of appeal from student visa. Otherwise I did not need ECAA visa but I had no choice. But now I am wondering what are my chances of getting PSW visa?
I havent made the application yet. I will do it in October.

Actually I was so unlucky because of my solicitor he sent my documents after he sent my passport. and HO refused the visa by only seeing my passport and some other documents. Everthing such as business plan was sent to HO after one month of original application.
