Spouse Not Supporting ILR Application, What Are The Options

Hello,

Thanks In Advance For Advice & Suggestions.

Married 2 years ago but things did not work out, Now due for ILR but spouse not willing to support application.

What can be done ?

Was mentally & emotionally tortured but have no record.

Please Advice,

Without the necessary evidence that you were abused it will be difficult to claim settlement under DV. Have you sought legal advice on this situation

What would be considered as evidence ?

Might get doctor's letter about anti depressant prescribed & counsellar's report on counselling done to me. What else would be considered as evidence ?

Is there no other way as culturally am not used to bringing out personal things ?

Merely being depressed in not sufficient. That would apply to every marriage at some point. I´m not implying that your situation is trivial; merely that you have only trivial evidence that would be unlikely to be considered. I think you will have to resign yourself to leaving the UK and, if you wish to return, look at the guidance for other categories of leave to see if you qualify. You still have rights under UK family law and should seek legal advice on divorce, but doing this will not freeze or extend your immigration status, which I assume is running out soon.
