ILR - Divorce

Hi,


My marriage didnt end well. I just moved out and live on my own.
Met My husband (british citizen) and married 5yrs ago, moved to UK under spouse visa.
After 2yrs married, I got my ILR visa 2yrs ago. tot this marriage gonna be forever, but he cheated behind my back and also mentally abuse me - shouting and insult.

I wonder, we now separated, not yet official divorce, do I have the right continue live in UK?

I would like to go holiday with friends. will I have any problem to come back to UK? Should I prepared to pack my suit case now, incase I cant come back in?


Is there anything I need to be aware of?
When I at the airport (after Greece trip)do I need to inform the official im now getting divorce?
my ILR visa is it still attached with my husband?

sorry about your situation.

you should be able to apply for citizenship as you mentioned you got your ILR 2 years ago.

have you any kids?

no, i dont have any children.


Before we married, he said a lot of nice things, like: have our own family, he hope baby girl look like me and such..
but after married, he asked me to wait for 2yrs.. after 2years, he said he have changed his mind, he worry English + Chinese mixed child will look weird, will look ugly, and will get bully at school..
once, I tot I prenant (because delay for 2months), I told him I might already pregnant. he ask me to go abortion..

He really break my heart


I havent decide should I go back to my family/my own country. I got a good job in UK, and friends..
I dont mind really.. if I cant get in to UK.. it just I am not sure should I pack everything in case I cant come back in. or should I not worry?

Forgot to mention, the greece holiday is end of this week. holiday is booked.. so wont have chance to apply citizenship..

If you have ILR then your permission to stay in the UK no longer depends on your relationship with your husband. You should be fine.

If you've had legal residence in the UK for 4 years, you should be able to apply for British Citizenship in just one more year. (5 years in total).

As Kitty has confirmed, even though you are divorced you are no longer under Immigration control and can travel freely. Just make sure you're not outside of the UK for more than 90 days in the 12 months before you apply for Citizenship.
