ILR application for dependants if passport lost -Please help

ILR application for dependants if passport lost -Please help

Dear all

I am in a desparate sitution for help and your advice will be great relief for me.

My family went to Pakistan in April 2011. My wife and son passports got lost in Pakistan. Ther are still there and waited so long with the hope that somebody might return their passports but no luck. Now they are applying for the visa in Pakistan.

I was on Tier 1 (General visa) and applied my ILR in July 2011 and was successfull. My wife is dependant of mine on Tier 1 (General) visa since July 2009. My questions are:

1. Do i need to send any documents to Pakistan to support their application and what documents if any?

2. How long it will take them to get visa from Pakistan?

3. Assuming my family come back in the UK in Mid Nov which will be period of 7 months absence from UK, when can I apply for their ILR. Is it starighaway or after waiting any period?

4. What form do I use to apply for my wife's ILR i.e ILR(M) or ILR(O)?

5. Any other advice which I shoud be aware of?

Few things about my situation are; My wife and son had dependant visa until 16/02/2012. My wife's two years period in the UK would have completed in July 2011 and she is 3 mohths short of completing her two year period in the UK as she came in UK in July 2009 until April 2011.

Please reply as I desparately need your replies.

I hope your family had purchased return ticket from UK and they are having photocopy of bio-data and visa page of the lost passport. If so than talk to your airline and get new passport from Pakistan.

There was post on this board where in an identical situation the member was allowed to travel without a visa on new passport and immigration officer allowed entry at airport with the advice to immediately apply to UKBA for TOC.
