ILR eligibility for spouse

Hi,

I have been living in the uk for five years under work permit / tier 1. I am eligible for permanent residency in the UK. My wife joined me in the UK 4 1/2 years ago as my dependant.

We had a baby earlier this year and for that reason she had to live in India for about a year there, while I continued to work in the UK.

I would like to know whether she is eligible for permanent residency in the UK even though most of last year she spent outside the UK ?

My elder son was also stayed with her in India for the same time period. Is he eligible to apply along with me ?

Please help !

Yes, if they enter the UK as your dependants before you apply.

1. She lived in India for about 18 months before that as well. So I am wondering whether living outside the uk for 2.5 years out of 4.5 years would cause any problems.

2. I am planning to apply for ILR for my wife, my two kids and myself at the same time. In the worst case, if my wife's visa is rejected for not being in the uk long enough, will they reject ILR for all 4 of us ? or only for my wife ?
