Spouse Visa 2011 Application

Hi All,

Needed some advice.

I came to the Uk from Pakistan in 2004 on Student Visa. I extended the student visa until 2008. In June 2008 I applied for IGS (International Graduate Scheme) and was granted it for 1 year.

At the time of extending the IGS, it got refused, stating that the college I studied at was bogus.

I applied for COA at the same time which was granted and in May 2010 I had my civil marriage with my british wife.She works full time.

I now have no Visa and want to apply for spouse Visa.

I have been informed that I have to go back to Pakistan to apply for the spouse visa?

Will the rejection of my IGS extension affect my spouse Visa Application?

I have also been informed that If i have been living with my wife for 2 years in the UK I can then apply for spouse visa in the uk?

You have overstayed your leave for a considerable period. That would not be sufficient to refuse you a settlement entry clearance but there are certain situations that fall under paragraph 320 11 of the immigration rules that may have a bearing on your application. You have not elaborated on your situation so you will have to see for yourself if any of the following applies to you:

what more information do u need.

and further more i have been living in the UK since 2004.

The court did say that all my college documents of which i obtained the IGS were fake, although i did attend the college and gain the qualification.

How will this affect my FLR(m) application?

I think you need to urgently seek private professional advice on your situation. You can`t expect answers to your complex matters on a general immigration forum and especially on the scant information you have provided. Do not leave the UK before you have be advised accordingly and an in country application for DLR might be your only realistic option. Good luck!

thanks for your advice, i know the matter is a bit complex as the solicitor told me as well we can apply for DLR within the UK.

As the solicitor told me a have family connection in this country.

i have met with my wife in 2008 we got engage in 2009 have all the proof since we met all photos where ever we been together, have civil marriage and nikah certifacte and even we have cinema tickets we been together back dated 2008, and all other proof about our relation since i met my wife,
