psw visa refused - passport held back

psw visa refused - passport held back

hello all,

I applied in person psw yesterday(26th Aug) in Cardiff centre, and was verbally told I will get a rejection letter soon as my letter from uni was not having enough info - 'degree not awarded'. My passport was also not returned.

Does anyone know why passport is kept? I need to travel to India next month, not sure how/when I get back my passport at least.

They will send you the passport with the refusal notice. But if there are issues with your immigration history they may send it the enforcement team. I assume everything about your status and circumstances are not irregular and that it will be the former procedure rather than the latter.

What information was missing in you letter.

Just as knowledge as I have to apply soon on the bases of such letter because the degree will be awarded later.

The case worker told that my letter does not state that my degree has been formally awarded by the uni. It only states that I passed all the subject and the degree would be awarded soon.

Well, if you have passed all the subjects and University saying degree will be awarded soon then rejection doesn’t make any sense, nevertheless its brainless Home office with mindless rules. Thx anywz

In that case it was a correct refusal. The guidelines are very clear on this. Would be awarded soon is a construction using a future verb tense and is not the same as is, was, or has been. The letter from your college, worded is such as way, was not suitable.

i am less concerned now about refusal, and more on getting back my passport.. so that I can re-apply within 30 Sep (my student visa end date)..

does any one have a clue how long it takes to get the passport back?
does it come back with the refusal letter?

it takes 2-4 weeks, and in some cases 4-8 weeks

When are you expecting your degree to be awarded ? You shouldn't have applied for PSW if you don't have the award in your hand. Usually university provides your degree certificates within 4 weeks of graduation. If you need more time you can wait till your student visa expiry date and apply for PSW, Pay with a Cheque and buy some time, Then as soon as you get your award apply for "Change of Circumstances" and get your PSW. Obviously its your fault for applying now and even doing a same day PEO !

You can always go back and apply from India.

you don't need a degree certificate to apply for PSW but the degree has to have been awarded and you need a letter from the tier 4 sponsor confirming this. If it hasn't been awarded and an applicant applies before the date of award, the application will still fall for refusal even if s/he is subsequently awarded the degree before the application is decided - as for PBS applications you have to meet the rules on the date of the application - so your advice wouldn't work either.
