Is it possible study with a dependent visa?

Hi folks,

I've been living in the UK since November 2010 with a dependent visa, as a dependent of my wife who is a postgraduate student with Tier 4 student visa.

I've got acceptance from an Uni for a postgraduate position. About visa issue, UKBA says that I cannot switch into Tier 4 student visa and should go to my home country to apply. But University says that I can register with my current visa (but only problem is that my visa expires before course finishes and according to uni this is not a big issue and I can solve this later).

At this case, my questions is:

Must I switch into student visa or my dependent visa is enough to register and study?


If I can study with my current visa, it is perfect when consider time and money to go home and apply to new visa.

If I cannot study with my current visa, I know that I have to go home; I cannot switch here as UKBA says.

Uni says so, but I'm afraid of doing anything against the rules of UKBA.

How do you know it is OK? Is there anything written on UKBA's webpage or are you a student with a dependent visa or do you know someone studying with dependent visa?

Well then, with that in mind, there is little point in you asking questions to anonymous strangers on a free access open forum. The people here could be telling you any old rubbish and laughing their heads off. However, usually when incorrect information is given out, another member may step up and challenge that view with an alternative position.

By the way, I don't see any relation between "asking questions to anonymous strangers on a free access open forum" and "trusting people".

Of course I don't rely on everything I read on web, and of course I always ask for more info, source, reference. This is what everyone should do!

Thus, I don't think it was a bad thing asking what was your opinion's basis. I would mention again that I'm sorry if I hurt your feelings.


If you could be so kind to answer my question, I would be very happy.

Because:

If there is something written on UKBA's page, I can use it as an evidence to convince UKBA or government or whoever claims I did a mistake, if something goes wrong.

If you are a person who is studying with dependence visa, this means there is at least one person who is studying with dependence visa and there is no problem.

If you know someone who is studying with dependence visa, again this means there is no problem.

if you couldn't study then it would say so on your entry clearance/visa/residence permit.

Generally speaking the only people who cannot study are visitors (although students visitors obviously can).

Have a read of the PBS dependent rules specifically 319D - 319D Periods and Conditions of Grant You will note that there are certain conditions including registration with the police for certain people, and restrictions on employments depending on what course and at what type of institution the main migrant is studying at, but there are no such restrictions on studying for PBS dependents.

Actually, I read the rules at the link you mentioned and my conclusion is similar with what you said. And Uni also says that I'm able to register with my current visa.

But, as the autority is UKBA, and there isn't saying anything like "a person with dependent visa can study without switching student visa" anywhere in that rules, I can't stop myself worrying

I think I'm very pessimistic or let say, I don't like risk

if you want to waste your time leaving the country and applying for a tier 4 visa go ahead. The conditions are set out in the rules and they do not include a prohibition on studying. UKBA does not generally list everything you can do, but things you can't do. If there was a prohibition on you studying it would say so on your visa, it would state it in the rules, and the university would not be willing to enrol you.

I know people who are enrolled at universities with PBS dependent visas, but telling you this is no substitute to referring you to the actual rules that govern the visa you have.
