ILR 10 Yrs Query- Dependant while both parents are applying

Hi everyone,

I and my wife both are eligible for ILR under long continuous stay (10 years) in October and we have started preparing our applications using the SET(O) form. However, I am not quite sure about how we can make an application for extension of visa for our son (born in home country and his visa expiring in November 2011). As ILR under 10 years Long Stay category does not allow us to include a dependant, can anyone suggest which is the appropriate form to use? I was thinking to use FLR(O) in the first instance and when we get our ILR, he can apply through SET(F). Can you please confirm whether this is alright?

Another question: As the address to send ILR (SET-O) 10-year form and the one to send FLR(O) are different, I am also not sure whether I can send all of our visa applications at the same address (i.e. in one envelop but separating 3 applications)? I thought sending our applications together will help the case worker to make sense of our cases better (and also because we cannot provide originals if we were to make separate applications). Can you please suggest whether this is fine?

Use SET(F) for child, as suggested in the SET(O) Guidance.

As my son's visa ends in mid-November, I am concerned that I will not be able to use the SET(F) form. SET(F) form is to be used only for those who already have their parents settled in the UK (i.e. at least one of them has ILR status). Is not it so?

When I apply in October first week, I do not think that I will be able to get the outcome of my status by mid-November. Hence I have thought of applying through FLR(O) first. When we hear the outcome of our ILR status, then we can apply again through SET(F). What do you think? OR can I directly appy through SET(F) for our son explaining the details in the cover letter? Please give your suggestions. Your advice is highly appreciaed.[/quote]

The SET(O) Guidance does suggest that child applies on SET(F). Enclosing a covering letter is a good idea.
