it's few months since new rules came into force and many WP holders are failing to meet the salary criteria. but no one knows what is happening and what is best option available.

i am starting this thread so that we can update each other or discuss options available.

i myself not meeting the criteria. but don't know what to do. my employer is not ready to give me pay rise. very upset. :cry:

i have called ukba call centre to check if i switch to tier2, after when i can apply for ILR(have completed 5 years on WP). she said your clock will reset as your current employment is not inline with tier2 guidelines regardless i am on old WP.

wp holders can you share your situation. is there any chance to challenge in court.

I am in the same situation, my salary does not match the salary in COP for my job title. My employer said that they would look at the job description and not the Job title and they have seen this case with another employee.

So, if you look in the COP and find a job description closest to yours, with the appropriate salary. Ask your employer to write the letter with other job title and hope for the best.

I have no idea if that would work or not, I would find it out myself in December, when I apply for ILR myself.
