Hi,

I am eligible for ILR in May 2012 and looking to book an PEO appointment in April 2012.

My wife and I are married since March 2010 and have been living together. So she will be completing 2 years cohabitation in time for the ILR.

However,

1. She was on Tier 2 Visa from March 2010 till Nov 2010
2. My dependant from Nov 2010 till date

I have gone through the UKBA site thoroughly and it only says Spouse should be with you for 2 years. It doesn't talk about case like this.

I have two questions now:

1. Will she be eligible for ILR at the same time as me?
2. With the recent Family consultation proposals for increasing Spouse cohabitation time from 2 to 5 years, will we be affected in April 2012? Or will these rules apply for future applications?

1. Yes, if you can provide evidence(s) of cohabitation since March 2010.
2. You will know, just as as everyone else will, when the government makes an announcement in this regard.
