Not sure if other members on this board agree but I would say it makes sense for him to send all those documents. As no doubt you will need the supporting documents you submitted originally to argue your appeal i.e. wage slips, Nikah Nama and bank statements.
What's the difference between Refusal Notice and Appeal Notice?
Do I need to get new bank statements? (As it would take me 10 working days to get a new statement as its not a card account).

Sorry to hear about the decision. My sincerest advice to you will be to contact lawyers. Please do not waste further time asking for ppls opinion who are not qualified. No offence to ppls who ar etrying to help, but we need professionals to sort out these matters now.

I know SmithStoneWalters very well. They are very competent and did my HSMP extention case when they change the rules overnight.

I suggest, google them and contact them make it simple and quick... time is really precious we can't waste it in experimentations.

waiting for passport collection

hi,

I have submitted my passport on 12th aug 2011 at gerry's karachi after receiving call letter in july , can anyone provide me information on how long is the waiting process now adays? originally my case was submitted on june 2010 which went to appeal and they withdraw their decision in july 2011 they took 1 year for this process, anyone received their passport in sept? thanks

My Solicitor has filed the appeal today to Leicester and see what happens....

Can anyone tell me how long it will take for the appeal to come through???

I would advice dont waste time get in touch with a Solicitor in your area who is specialist in Immigration, I got it done from Bradford..... If you need the detais i can give it to you.

on average passports are returned after 30 days. Look at the spreatsheet provided by members of this forum. You should be hearing something next week i guess.

Sorry to hear that. Bad news.

Yo need to first of all calm down.

You need to give the exact reason for the refusal as per the refusal notice, so we can advise and suggest things for you to do.

You need to get your husband to send you refusal notice and appeal notice here in UK, so you can start the appeal process.

Get this done first and we'll take it on from there.

Do not be despondent about it. It is what Allahs willed for you. Do it with sabr and Allah will reward you for it in the future
Do they give refusal notice and appeal notice with the passport?

A number of people her have claimed that they have done their appeals from Pakistan. This is not right and incorrect.

For a start only certain qualified people in the UK can do appeals ( if the sponsor themselves are not doing it).

It is advisable that the sponsor does all the work.( the applicant doesn't get involved at all after refusal.)

The sponsor who should be UK based should seek advice and get someone to represent them at appeal hearing.These same people should complete the appeal form and argue why the applicant should be given a visa. these same people will then argue their points in court if it goes to an appeal hearing.

What a few people have done is got someone to complete their appeal form in Pakistan ( because its cheaper) and then lodged their appeal at either the post where they were refused or IAT in UK.
The problem here is that if the matter goes to a hearing and you seek advice of a solicitor here in UK, he will be reluctant to take matter on because he will then have to try and defend the applicant on the basis of what teh Pak solicitor /advisor has written in the appeal form.

The UK solicitor might not agree to do this, and this will leave you having to represent your own spouse without any legally qualified person to help you.

It is therefore best to get a UK solicitor/Imm advisor to act on your behalf. I know it may cost an arm and a leg, but its not worth taking a risk in the long term.

You have 28 days from receipt of notice to lodge appeal. You will need the AIT2 form / refusal notice to send off with your appeal.

Thanks for the advice....

I have asked a Immigration solicitor from Bradford to Submit an Apeal.

The grounds for the refusal was that they dont except our marriage is satisfactory....... and the second thing was that they dont except that im divorced from preivious marriage........

We submitted all the Divorce paperwork which was the originals and also the new nikah was done through a registered union council Kaaari and we also got it attested from the Ministry of Foreign Affairs.

The Immigration Officer must have been blind because all the paperwork was there.......

Can anyone advice which other information i should ad with the appeal???

Can someone tell me how long it takes for the appeal to come through or get overturned???

ANY ADVICE WILL BE HELPFULL. THANKS.

Could take up to 2 months if after review they overturn initial refusal and grant visa.

If not then it could take 6 months before before you get an appeal hearing and if you are successful then add a couple of more months to get visa stamped in your passport.

does it really take two months for them to possibly overturn the refusal? The average time on the spreadsheet for appeal decisions seems to be 6 months

I would like some help on a few things i am confused about
1) on my monthly cheque my employer has given me £15 more after tax and national insurance this money was given to me as a eid present will this be a problem with the ECO does my employer have to write a letter to explain this
2) for the cheque of this month my employer has given me 20p extra after tax and national insurance this was just a over payment caused by a mistake in writing the cheque he hasnt taken the money back from me will this be a problem or not these to amounts of extra money have not been written on my payslips
The statements for these to months will be included in my paperwork
Help will be appreciated by any1 batleykhan can i please hear your opinion aswell

My husband will be submitting his bills that show he has been in contact with me. However I call him little and when I do I use calling cards.. I have no other proof, therefore I have got a letter from the card stall/company man stating I have regularly been buying phonecards from him to call my hubby.. (should I include anything specific in the letter, since when etc??? its not on letterhead but it is signed and with his details for further information).

I am getting a bank statement showing where money is coming from, however where the cheque is concerned they cannot help me, so I will get a letter from my manager to show we pay her with cheque.

Please advise me anyone. Thanks
I suggest that you get advice from a solicitor before submiting your appeal, as you need to have strong grounds of appeal and with someone professional they can Prepare the appeal grounds round the basis of law and regulations as well as advising you the do and don’ts based on your appeal, and Insh'allah the decision will be overturned and not go to a court hearing...Insh'allah

I don't think such small amount would demand an explanation. I would not worry about it to much

i've only been workin fo 3 months so i wont need a p60 then?? jus a letter sayin i work for them wil do right??

and the last tym i had a job was in june-september 2008..do i need anythin from my old employer?? adn that job ws only for 3 months..

My husband has requested phone bills from his phone company which he will be receiving in a few days. I want to know can he fax them over to me? As post will take long and I want to submit them with my review and appeal. I need them ASAP!

Are faxed phonebills ok to submit with review/appeal? Are they accepted?
As that is the most convenient way to get them..

Helloo..I require help from this forum and i have always found it to be quite useful especially wen my husband was gettin his ILR.
i am goin to apply for dependent visa next week,i just wanted to be sure about submitting the proofs of relationships docs.I m submitting the nikah nama (already in english,signed n stamped by council),wedding pics,honeymoon pics.
I wana submit emails from Gmail and the Skype coomunication me and my husband had through out the time since we got married which was 1st July.
I am wondering on how to submit the chats?shall i take sum print screen n print it randomly?cuz we chat n voice talk everyday over skype..
and wht about emails?how do i present them exactly?
Would be grateful at a quick response as i may be taking appointment for the next week wen i am satisfied wth all the documents i have.

It does if they decide to overturn the original decision on review. If its no overturned on review and goes to a full hearing then it will take a minimum 6 months :wink:

I don't think so, but if you are worried about it, then explain it in the supporting letter, the reason for the extra payment :wink:

heyy..nobody has answered my query..is it nobody is sure?
I have taken snaps of gmails..like printscreened them n then took coloured printouts of the dates of the exchnage of emails..a little bit of the subject can be seen..not the whole emails..hope it shud work?
we used phone very less after marriage..skype worked perfectly..

Hello,skype calling and email are fine just make sure they have dates on and tym,just to be a safe side i think you should have some phone call history aswell sometime they reject visa on base of low comunication,i personaly think you should get veton mobile sim or layca sim it 1p per min to pakistan and you can print call history.goodluck
