I'm new to this forum thing. I have a slightly complicated matter so I thought I'd give this a go.
Now there are two parts to this issue.
Problem Number;
1) My Husband is an over-stayer. He came here in 2002 in a 6 months visa from Zimbabwe.
He got married here to a British Citizen before his visa expired. He made, what he thought was a legal application to extend his visa but it turned out that the guy who was supposed to be a 'lawyer' was indeed a conman! So as far as the Home Office is concerned there is no legal application. Being afraid of getting sent back home, he thought it would be wise not make any applications.
My husbands 1st marriage lasted 6 years. It broke down mainly because of the stress of his status.
We have been together for almost 3 years now. We had an islamic marriage last year in July. I know that it is not recognised by the authorities but we had quite a big wedding.
Problem Number;
2) My husband is from Zimbabwe but He has an Indian passport which has expired. He went to the Indian High Commission in London to renew and was told that they CANNOT renew a passport without a valid visa.
The Zimbabwean High Commission told him that he needs to go to Harare to make an application for a Zimbabwean passport! So he's stuck in limbo!
My husband has lived in Zimbabwe all his life, studied there too. he has been to India once on holiday, when he was very young. He doesn't speak the language at all.
Now we want to sort out our situation, we were given 2 choices by a solicitor (who wasn't really that good but wanted £4500 for filling out a few forms!!), 1 was to leave the country, but we'r not sure how to, or which country to go to (India would be our least favourite place to make an application from as neither of us really speak any other languages apart from English and we have no relatives or friends there. Zimbabwe won't accept him as he was away from the country from more than 2 years and has probably lost his residency) 2 we make the application from here, which is a lot harder and very time consuming.
It's very frustrating being in this situation. I hope there is someone out there who can really help us out.
