my husband has been refused the spouse visa from Ghana because he thought he didn’t need to meet the English Language criteria. I had no idea he'd decided not to meet that requirement until he was refused. Naturally I was and sill am a little furious with him
Please see the exact wording from the decision below:
You have applied for settlement in the UK as a spouse. You are therefore required to demonstrate that you meet the requirements of paragraph 281(i) regarding your level of proficiency in the English language. You have provided none of the required evidence as specified in paragraph 281(i)(a) and do not meet the requirement set out in paragraph 281(i)(b). I am therefore not satisfied that you meet the requirements of paragraph 281(i)(a)(ii) to (vi) and (b) of the UK immigration rules HC395 (as amended).
I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all the requirements of the above paragraph of the immigration rules
He has taken the PTE Academic Test and is currently awaiting the results.
Please can you advise if this will be sufficient considering the reason given above? Does he need to write a cover letter to submit with the test results and appeal form he was given?
Do you know roughly how long it should take for a decision to be made?
