ILR PLEASE HELP

Hi,My conviction will be spent on jan 14th 2013 and my visa is until dec31st 2012 but my 10 year legal stay will be done in jan 2012,so my question is do i need to have one more extension for those 14 days before i can apply for ILR or can i apply by post on31st dec 2012 and wait for my ILR to be processed in the mean time even my coviction will be spent.PLease advice thanks for the help
