Spouse Visa App. while pregnant & sponsor is on benefits

Post by triniangelica » Tue May 03, 2011 3:54 am

Hello everyone,

I will soon be applying for a spouse settlement visa and would like some advice based on my situation. My fiance is a British citizen by birth and I am from the Caribbean. After a year long internet relationship, we met in person in June 2010 when he came to my country and stayed with me and my family for 3 months. After that I accompanied him to England where I stayed with him for 5 months. We have been on a holiday to Germany while I was in England in order to meet his mother. during our trip to Germany, he proposed and I accepted. In January 2011, I discovered that I was pregnant and due in September this year. My problem essentially is that my sponsor's (fiance) income is based solely on public benefits (IS & DLA) He became severely partially sighted a few years ago and subsequently had to leave his job. He enrolled in full time school so that he can try to have a well paying career in the future so that he would not have to remain on benefits all his life. With regard to me...I am not currently working due to the pregnancy (as it's difficult to get a job while you're already pregnant) I have graduated in April though with a Bachelor's Law degree from the University of London. I do have a good CV but obviously having a baby soon is going to prevent me from being able to show that I can work and maintain myself if necessary.

Based on the standard used to assess adequate maintenance....the current IS for couples is 106 pounds. The combination of IS & DLA which my sponsor receives is almost 165 pounds....clearly above that...though the fact that his entire income comes from public funds is a concern. I have my own bank account savings of 3500 pounds which is in my name.

It is essentially easier for me to adapt to the UK rather than him being able to adapt here and possibly find a job due to his sight. His mobility is also severely affected here as public transport is not at it's best.

Any advice based on perhaps past situations or general advice on our situation would be greatly appreciated. I have read the UK Border Agency's website continuously and the odds doesn't seem to be in our favour of being successful. In addition if anyone has samples of compelling & compassionate letters for expediting the process as the result of a pregnancy and can share it...that would be appreciated as well.

Thanks for any advice given!

To anyone reading this now, just thought I'd mention that I was successful with my spouse visa application and wish the best of luck to anyone else in a similar situation.

Regards,
AJ
