Appeals Made Against Decision in New York

Post by Booman1 » Mon Sep 26, 2011 8:16 pm

Not sure how many US Citizens or other people have to apply through the consulate general in New York, but am wondering if you have appealed against a refusal decision for a spousal or other settlement visa in New York, and how long it took? Mine was apparently received at the office on September 1st and they told me they would review it within 10 working days. Well it has been 17 now and still nothing. I understand the appeals process can take MUCH longer so I'm just hoping people have some positive stories for me? Did anyone get responded to within 10 working days? Or does 10 working days mean 3 months?

If you are referring to the ECM review stage of the appeal, it takes about 3 weeks on average (so 10 working days!), as cited on various forums in the Americas whose applications are handled by the New York Hub. However, it depends on the reason for the refusal and what, if anything, you sent in as additional evidence. The most it can take is 8 weeks but that would be exceptionally rare for that EC Hub.

Ah yes I am referring to that actually. I appreciate the feeback it has been 17 working days and still nothing, however you telling me that it sometimes takes 8 weeks gives me some reassurance. Also the fact that we submitted TONS of additional evidence might have something to do with it. Hopefully they are looking at it and considering it thoughtfully. My initial worry is that they are so busy they haven't even been able to start looking at it yet, or that they have upheld or overturned the decision, and have forgotten to e-mail me. I know that the NY hub is one of the best and most professional consulates around but even then its easy to get lost in the storm! So worried...just want my lady back.
