ILR qualification query

Post by vp77 » Wed Sep 28, 2011 5:36 pm

Dear Seniors,

I have a query on the ILR qualification timeline at current rules.

I know, I am asking for this clarification quite early in my 5 yrs qualification stage but I want to play safe now rather a regret in future.

Below are my Tier 1 General visa facts :

Visa start date - 15 Feb 2011
UK entry date - 4th May 2011
Visa expiry date - 14 Feb 2013

Now, I need to travel to India for 15 days in Nov for an important family occasion.
As evident, I landed in UK after 78 days from my visa start date and now, planning for an out of UK trip for 15 days.

I feel, I have already breached the timelimit and will have to go for 2 extensions after the current visa expiry.

So would my planned travel to India for 15 days really change the situation since I have already breached the timelimit by coming late to UK by 78 days after the visa start date.

Please advise at the earliest so as to enable me to plan appropriately.

Thanking you in advance.

Absences from UK has nothing to do with date of entry in the UK, other than that unless one enters UK there can be no absences.

ILR qualification query

Hi sushdmehta,

Are you saying that there is no impact whatsoever on my late entry in UK after the visa start date i.e. no impact on ILR qualification in future?

Thanks

No, I said that (late) entry to UK and absences are two different issues. And one doesn't affect the other!

Reading FAQs for ILR - WP/Tier 1/Tier 2/HSMP holders should help.
