Tier 1 Extension Required Points

Hi There
PBS Calc shows that i do not appear to have enough points to apply for permission to stay in the UK (known as 'leave to remain') under Tier 1 (General). I scored 95 points and the date of my first successful Tier 1 application is 1st Feb, 2011. I already did the assessment 2 months ago and it showed that i have enough points!!. I already know that the extension requires 95 points only Not 100, Did the rules have been changed, Can anyone confirm ?

total points score must be at least 95 points if you currently have permission to stay in the UK as:

a Tier 1 (General) migrant under the Immigration Rules in place before 19 July 2010; a highly skilled migrant; a writer, composer or artist; or a self-employed lawyer. If you are in any other eligible category, your total points score must be at least 100 points

Can i add Out-Country earnings to my earnings in order to collect the 5 points? And if Yes, Do i have to pay taxes for it to be accepted by UK BA Home office?
