Leaving UK and re-entering during RESIT examinations

Post by kaderpitchai » Fri Oct 07, 2011 12:12 pm

I am an international student doing M.Sc in London. I got my results and I got few resits in next year. I want to extend my student visa.My current student visa is expiring by JANUARY 2012. I got my dependants with me in UK. As per rules i have to leave the country with family in January and i can only re enter in april for resit exams. My resit examinations starts in end of april and if there is no participation of student for more than two months excluding vacation period then university is not going to sponsor me for CAS till the beginning of exams. My question is, can i apply for another post graduate course such as a english course or any other course in any other university during this gap in order to get sponsorship from that university?. If I withdraw that course within one month and apply for CAS in my old university for resit exams. I mean changing educational institution. Can i get extension without any problem from UKBA for both courses?. Whether my dependant will be able to continue work full time. How can i avoid going from UK during this two months gap. Kindly guide me.

Yes you can apply for another course at another university. It's quite common for sponsors to refuse a CAS for re-sits and, instead, suggest that students enter as a student visitor or, in some cases, they are able sit their exam in their home country under the supervision of the British Council. You should ask your current sponsor is they intend to issue you with a CAS for the re-sits, otherwise the second question is not relevant.

My University is ready to sponsor me with a CAS but with start date a week before resit exams till the completion of course. My question is How can i avoid leaving this country during the gap. My student visa expires by end of January and university can issue me CAS with start date in end of April.

Any new course you did in between would have to be considered to be academic progress by the tier 4 sponsor and again for you to get the Cas for the resits. I think you will find it difficult to circumvent the rules in this situation and it might backfire if it means you then can't get a Cas for the re sits.

If your visa expires at the end of Jan and the re sits are end of April you have three months not two. In addition you are presumably not studying at the moment-you therefore have 6 months before you will be required to study again and in which time you can return home

have you spoken to the international student advisor at your university?.
