Wife visa required, need some information

Post by Sycrid » Thu Sep 15, 2011 2:15 am

Hiya guys,

I'm curious about what we "need" and what is "good to have", when me and my wife apply for my wifes visa to go to the UK.

I'm a UK citizen, lived born and bred Geordie, I've been in Canada for 18 months now, as a nonplanned gap year, which was also extended without planning, and during this time I met my wife, we've been together for over 15 months now, we have lived together for almost 1 year, and we've been married for 1 month now.

My wife is Ukranian, is 25 years old (I'm 23), she has a masters in Business, and I have a bachelours in IT/Business. We have enough captial to survive a good 6 months in the UK without work. I have family who will support us, aka, a spare room for us to sleep in if we find that we need it.

My wife has taken the PET (Pratical English Test), which is stated as a particular requirement, and she aced it, with an 86% score, qouted Excellent on all stages of the test.

We're just wondering if this is enough for us to apply? Because a lawyer stated it would be good to have a place to live, lined up (aka rental agreement), and job offers.

- A rental agreement I think will be impossible to acquire before we get a visa, as we can not give a landlord a timeframe on how long the visa will take to be offered, if it is.

- Job offers, well this is difficult to acquire when we're so young, with so little job experience.

Are we in a viable situation, so that an application we submit would be accepted and not rejected?

Note: We're currenttly living in Canada, and have been for 18 months.

When you say you have capital to survive a good 6 months without working..how much capital do you have?

Do you have family in the UK you can both stay with initally on your return? That would probably be your best option if possible.

Sycrid has mentioned family providing a spare room 'to sleep in'. If the living space is considered adequate by the ECO this will meet the accommodation requirement...but most importantly we need to know how much funds Sycrid believes will sustain them financially without employment for 6 months.

Hiya,

Sorry about the incredibly late reply... work had us occupied like crazy for the last few months.

Capital wise, I can say we have about 10k, in GBP.

Any use?

ok so there are four areas you will need to prove

English lang- sounds like you have this
Acommodation- You will need then to use your parents house , they will need to send a letter that they are happy for you to stay, give a description of property and floor plan if they have since to prove number of rooms, you have to pass the housing act for overcrowing also. council tax bill and mortgage or utility and pics of the property
Relationship- photos of your relationship 5-10 is enough, trips taken together wedding pic.
Finance- 6months bank statements and an excel sheet to prove that you have 107 per week after rent and council tax

if you have that you should be fine. It will be approx 30-50 page doc. together with her residency in Canada what kind of residency does she have?. 10k sounds fine but also prove both your employibility with cv and education docs.

If your parents house is rented they will have to provide a letter from the landlord agreeing to you living there.
If mortgaged, a copy of the mortgage agreement/statement.
If owned outright, a copy of the property deeds.

The exact amount you need to show you'll have remaining weekly is £105.95 after rent (if you have to pay any) and any loans/credit repayments. ECO's generally overlook council tax calculation now but it would be prudent to include this if it applies.

Hiya guys,

So it seems that we can't stay with the parents, as my mum does not own her home, its a council house. In addition to this, our lawyer said it'd be best for us to get a job offer before we apply, as we have found a friend who has given us a tenancy agreement, so we can live with him at his place. We'd be paying him 300 per month, and then we'd be paying 100 in council tax or something, so the lawyer said when we factor this in, plus the flights, costs of lawyer, and immigration application, we're unlikely to get through. 10k will not be enough...

I'm stuck though, we're running our of time in Canada, as our visas are to come to an end. I'm left puzzled, how do a 23year old and a 25 year old find work 3-6 months in advance, or have enough finance to last 2 years (like 40k or something), this seems crazy... we're running the risk of being torn apart by our governments.

Can we apply for another kind of visa to kill 1 year, where my misses can join me in the UK, whilst we look for work and a place to live, and then apply for her to join me on a more permanent basis. I've asked the lawyer this, and yet to recieve a reply. (The biggest thing I hate about this, is how the lawyer has charged us £450, and simply told us that our odds are very slim).

You can live in the Council house with your family as long as the Council (as the landlords) will give their permission for you to do so. The rent book should state the regulations on this. You would also need to show that the accommodation won't be overcrowded.
You do have the option of returning to the UK ahead of your wife and then applying for her spouse visa once you've found employment.
