URGENT ADVISE!!ILR due, but given notice by company

Post by sah06 » Mon Oct 10, 2011 9:14 pm

Hi,

I have completed my 5 year on work permit and am eligible to apply. Infact had taken a tentative date as well for same day ILR process. Just the day I went to collect letter from HR I was told my job will be ending in 6 weeks time. As per SET(O) form , letter from employer should mention that WP holder is still required by company however as per my HR they will only mention that I am required fpr next 6 months. Can anyone please advise if I am eligible now to apply considering my job will end in 6 weeks time. Please reply asap as I have very little time left.

134. Indefinite leave to remain for a work permit holder wrote:(iii) he is still required for the employment in question, as certified by his employer; and
(iv) his employer certifies that he is paid at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 Sponsors published by the UK Border Agency,

The only problem is : as per employer they will mention the date he is required till i.e 30 Nov. If this happens I am concerend that the Home office will not accept this as continous employent..Cannot understand how to convince the HR...
