Tier 1 General Dependent Visa

Hi Guys
If you can help me or answer my question
I had applied for Tier 1 General visa in January for me, my wife and my son. My visa is got accepted. My wife and my sons' application is refused. The reason for it was they for got to sign application form. They are still in UK on PSW dependent (I was on PSW visa before). Their visa is expiring on 31st July 2012. To apply as my dependent do they have to go back India or can they apply from here.

Your help will be appreciated
