I am a bit concerned and worried here.

My application was sent on 06 September 2011. Until today the 07 Oct 2011 I have not received the acknowledgement letter or the biometrics invitation.

I have processed my application through qualified solicitors Drummond Miller LLP in Glasgow so its hard to hold them to it but I did received email from the solicitor to be patient.

Today I phoned the secretary to the solicitor to provide me with the tracking number and she didnt had it as she said some one else posted it. And she took it very lightly and replied I will come back to once I have it.

Phoned Home office they didnt had any record of my application.

Dont know what to do here as I it wont be right to point finger at anyone and cant just sit and wait either because its way out of usual that even after one month I have received nothing.

My VISA expiry date is 13 Oct 2011.

May be his secretary forgot to sent the application and the solicitor doesnt even know.....!

What do I do.....!

I need to know what my options are in the likely event of my application being rejected by Home Office. My VISA ran out on 13 Oct 2011.

I would really appreciate some advice here please before I start packing up my bags.

1. The fact you have received an invitation to enrol your biometrics is an indication that you have made an in-time, valid application (i.e.- use of right form, duly signed, fees paid etc.).
2. But this invitation letter is in no way an indication that the documentary evidence(s) you have submitted to prove that you fulfil the specified requirements for leave to remain as Tier 1 (General) migrant have been deemed as valid or that you have met the requirements (i.e. - that your application is being / has been assessed / approved).
3. At this point, the only way to know the "date of application" and in turn whether your (maintenance fund) bank statement(s) were valid on the date of application is to ask the solicitor to provide you with the proof of "date of application" - depending on how he has submitted your application (post, courier or in-person).
4. If an in-time, valid application has been submitted (which the issue of biometric invitation letter indicates), then your current leave remains extant under Section 3C.
