Entered UK six months after EC

I was granted Tier 1 visa on 12 th feb 2009 but entered the Uk on 9th aug 2009 as my solicitor told me it won't affect my ILR as i entered before 6 months. Do u think that this will affect my ILR application. Pls lemme know am worried now.

1. You'll need to apply for extension before your current leave expires - if you wish to remain in the UK as a Tier 1 (General) migrant.
2. Then, as and when you fulfil the requirements for settlement, you may apply (you don't have to wait until the end of new leave to apply for settlement).

1) what does current leave expire mean ? Is it 3 yrs or Â total 5 Â period.
2) can u pls explain second point what is the requirement for settlement? And how long will the new leave be valid for?

Just wanna know do I have to go back to India as I am not eligible for ILR? Or can I apply for or continue same tier1 visa but with one more extension of 2 yrs. And then as soon as I finish five year in total I can apply for ILR.Â
Also pls lemme know what is the criteria for extension after I finish my 4.5 year period.

"Current leave expires" means "the expiry date given on the current visa in your passport".

You are still a long way away from settlement .. and no one can tell you today what the requirements for settlement may be in 2014 .. so this question is best left for the future (closer to 2014).

As explained above, you'll need to apply for extension before your current leave expires (i.e. - before the expiry date given on your current visa). The Tier 1 (General) policy guidance explains the requirements for extension and the period of extension leave granted, so please read it.

Upto 3 months shortfall acceptable for ILR mine is 5 months? What do I need to do?

I know I will have to apply for FLR before I apply for ILR. All I want to know is after my 5 yrs are over can I apply for an additional extension and then ILR? Yes Or No or do inhave to leave the country .?

Ah! So you haven't even applied for your 1st extension yet!! Now I can understand why "current" became the point of contention.

Course of action:
1. Apply for your 1st extension (FLR) as and when it is due.
2. Apply for 2nd extension (FLR) when the leave granted under 1st extension is due to expire.
See 245CB. Period and conditions of grant.

As and when you fulfil the requirements of settlement (as applicable on the day of such application), you may apply for settlement (sometime in 2014).
