HELP NEEDED!- ILR for spouse with SET F

Post by BestA » Wed Oct 19, 2011 6:59 pm

Hi,
My husband has ILR. We have been living together for 6 years and have been married for 1,5 years. I am in UK with a student visa.
I contacted Home Office and they stated that I should apply with SET F form as I do not qualify for SET M (as I do not have a spouse visa).
However, SET F form states that my husband should support me and I should not have enough funds. But I do have enough money to look after myself in my UK bank account. Will this cause a problem?

Any help is appreciated! thanks

SET(F) is absolutely not the correct form for you to use.

If you currently have limited leave as a student and your husband has ILR you should apply for further leave (not indefinite leave) on form FLR(M) providing you meet the requirements of the rules.

There is ample guidance on this section of the forum about the requirements and evidence needed.

Hi, I received a letter from the UK Border Agency stating that I should fill out SET F rather than SET M.
They told me that as I do not have a spouse visa for two years which is a requirement for SET M, I can only get my ILR with SET F.
I confirmed this from two different people at the Border Agency.

However, the SET F states that my husband needs to look after me and I should not have enough money. But if they check my bank accounts, I have large sums of money. Will this cause a problem?

As Greenie mentioned in his response above, you do not yet qualify for settlement - so neither SET(M) nor SET(F) is to be used.

Switch to FLR(M), as also already advised.
