ILR10 year - few basic queries

Post by arsenal49 » Fri Oct 21, 2011 11:58 am

Here are some basic facts for you before i pose a question below.

I am hoping to satisfy residential requirement for ILR for the period between Oct 2004 and Oct 2014.
I arrived in this country in October 2004 on a student visa
I was out of the country for 3.5 months in year 2005.
I was out for less than a month for years between 2006-2011.
My stay has been entirely legal for all these years, and will be legal for rest of the 3 years or so.

My concern is:

due to the fact that i was out of the country for 3.5 months in 2005, does that mean that year will not be counted towards 10-year residency.

So, in effect, will i have to delay my ILR application until Oct 2015 rather than October 2014 because of that?

Also, i did not have a NI number for first two years (Oct 2004 - Oct 2006) and no part time job, so no P60 etc. to prove my legal status for those two years.(Remember i was a student at that time). What document must i produce to show i was a legal resident in those two years. I would imagine the fact that i had a valid visa should suffice but i just wanted to be sure.

Will appreciate your replies.

Thanks

See Long residence (276A - 276D).
The SET(O) form explains the documentary evidences required for such application.
