Settlement - Sufficient Funds

Post by simonj888simonj888 » Fri Oct 28, 2011 8:49 am

I am British and my wife (4 years + married) is Thai and we have 2 kids (British Passports). We are currently living in Thailand. I want to return to the UK and take my family. My wife wants to settle in the UK.

My question is regards 'Sufficient Funds'. I will need to look for work once I return to the UK. We have funds but not a great deal. So, I am worried that if my wife applies for a visa it will be rejected because on 'Lacking Funds'.

I fully expect to get work fairly quickly once I return to the UK, please advise which is the best route to take?

Many thanks.

In your case it's not a tangible amount. If you had an on-going income (that would continue or be immediately available on your arrival) you would need to show (for a family of your size) that it was more than 1000 per month after accommodation costs were accounted for (when those costs, if applicable, have been subtracted from the net pay). However, in lieu of no income an amount of savings or third-party benevolence is required. What this amount should be would depend on your particular outgoing expenditure.

If you don't have savings or access to third-party support and think a settlement application is not possible, you might consider visiting the UK with your family. You could use those six months to establish yourself in work and then, only your wife need return to Thailand and make an application for settlement.
