Tier-1 extension delay

Post by reachvilli » Fri Oct 28, 2011 1:11 pm

I applied to Tier-1 extension end of July by post and went for my biometric on 24th Aug 2011.
I know that some cases it can take time and we need to just wait.
But just out of curiosity -
Maybe there is something which can be done to track the stage of my application??
And how long should I wait to start an inquiry???
If i want to revoke my application back to get my passport to travel, how long will it take?

In UKBA website thay say 75% applications are completed within 4 weeks, mine seems to be in 10th week now.

UKBA will not entertain any "status" enquiry before 14 weeks from date of biometric enrolment. Not saying that they will do so even after 14 weeks!

You say you work on "contract" basis .. but have mentioned as "employed". Please explain how?

Do you work on fixed-term contracts as an employee of an umbrella company / agency?
Do you work as a sole trader / proprietor as a self-employed individual?
What evidence(s) of "earnings" have you submitted for your application?

Don't know if I should wait for another 4 weeks and still not get any status update or just withdraw my application...

I am not a regular employee of a company(xyz) but work as freelancer for fixed term contract basis. My agency(abc) makes a contract between me and comapny(xyz). The agency(abc) is responsible for my salaries or earnings which are based on daily rates. I dont know if this defines it as umbrella company?

I submitted my bank statements and letter from the agency(abc) showing my employed period with them and payments for individual months (which varies). I was on this project only for few months but that was enough to get points for earnings.

Without my passport I cant travel and I have to sit at home without earnings, which is bad :(

1. Do you get "pay slips" from this agency?
2. When is your current leave due to expire (if it hasn't expired already)?

1. Yes I do get payslips by email but its more like salary statement.
2. I current leave already expired in July 2011.

1. Okay, if you get "salary" from the agency then you are "employed".
2. If you withdraw your application (to travel), you'll become an overstayer in the UK from the day you you submit such a request.

Thanks for letting me know that if I withdraw my application then i become overstayer. I had no info about this. Really appreciate.
If my application is denied, do I still become overstayer? Or, how many days I have to leave the country?

No.

If you submitted a valid, in-time application and it is refused, then you will be granted the right to appeal. One has 10 days to submit an appeal. If you do, you will be protected by section 3C leave until all appeal options are exhausted. If you don't (submit an appeal), you will become an overstayer at the end of the 10 days.
