at appeal: how to answer to home office

Good evening,
A lawyer recommended me to be honest and come clear exactly how I entered UK, in case the home office will tackle that point. Can someone tell me what they think is best, should I do that, is it not very risky? Does anyone have experience dealing with such cases.

I am extremely worried about this.

Also, I expect the home office will ask me many difficult questions, what do I need to be prepared for, what kind of questions could be asked?

Let me get this straight ..... you are asking people to tell you if it is appropriate to lie to a judge in a court of law?

You have to be honest.If you are dishonest they are unlikely to believe you and you will loose your appeal.

The HOPO will be out to catch you out and if the judge thinks you are telling lies you are finished.You want the judge to be on your side and they don't like being lied to.It does not matter what UKBA say all that matters is what the judge thinks of you and your situation.

As for the questions you are likely to be asked ask your lawyer and always follow his/her advice and do not deviate even an inch.

You are lucky they have not punished you for using false passport.Judges see this all the time and they might view your case differently even if the HOPO brought this issue up.

I can guarantee you if you tell porkies in court your appeal will be dismissed.Judges are clever people they deal with complex cases and the last thing they want is someone who tries to outsmart them.

As for the passport it all depends on why you decided you needed to use one.

Don;t be scared if going to court but be very scared if you want to tell porkies in court cause they will find you out.

If you are a family member of an EEA national as you previously stated before editing it for reasons best known to you, and engaged in a genuine marriage, i find it difficult to see how the method of your entry will be of any relevance to your case. I am really not sure why your lawyer think it is relevant, that it may be asked, and that a truthful answer will determine the outcome of your case.

Yes i believe in truthfulness and honesty, and would not advice anyone to tell lies to a court or tribunal. However i believe the genuiness of your marriage carries substantial weight.
