Need help please. Please guide me what shall I do ?
The dates are

1. Original Visa Stamped : August 2006
2. Extension Visa stamped : September 2008
3. Visa expired : September 1, 2011
4 I applied for ILR : August 2011

Though my visa was stamped on August 2006, I came to UK for a short period of 10 days in October 2006. I returned to the UK in February 2007 for a permanent stay and have been here since.

I was told through call centre I am eligible to apply for ILR using SET(O) form. I applied and have now received a Rejection Letter because I have not finished 5 years in the UK.

I cannot re-apply, since I do not have a valid visa (expired on Sept 1 2011) and now learn that I have to leave UK.

Can anybody provide any guidance and offer advice.

Exact dates below :

1. Date of issue of entry clearance (2006) as HSMP –Aug 10, 2006
2. Date of FIRST entry to UK – Oct 1, 2006
3. Date of exit – Oct 6, 2006
4. Date of RE - ENTRY to UK – Feb 4, 2007.

Here is the further total days out except the above……

Number of days – when – reason
35 days - between December 2007 and January 2008 – annual paid leave, official work also done
18 days between December 2009 and January 2010 – annual paid leave, official work also done
11 days in December 2010 – annual paid holidays, NO official work done
23 days between January 2011 and February 2011

DATE OF REFUSAL ; OCT 17, 2011 and given the right of appeal

WHAT IS THE SOLUTION ?

Shall I make extension application as my visa expired on 1st sept 2011.,
Can extension application be made after an appeal?
