Hi There,

My wife is in UK on Tier1 visa, now we are planning to apply for her Tier1 to Tier1 Dependent from UK itself.

Could some suggest, whether its eligible to apply for shifting from Tier1 to Tier1 depended from UK itslef.

We are doing this to avoid any confusion at the time of MY ILR application - which is due in 2011.

I am afraid, not. The guidance says:
Switching is permitted when applying as a family member who
currently holds leave as the partner or child of a person who
had leave under another category and who has since been
granted, or is, at the same time, being granted leave to remain
as a Relevant Points Based System Migrant.

Thanks for those responses,

Myself had got my HSMP - Tier1 extension a week before.

Now, I am trying to change my wife's visa from Tier1 to Tier1 dependent. For some reason, we havent sent her application along with my Tier1 extention application.

She is also in UK.

This we are trying to avoid any complexities towards my FLR, which is due by 2011 June.

Could some one suggest me please, whether it allowed to apply in country to switch from Tier1 to Tier1 dependent. I have all the suuporting funds ready on this.

Hi, If I understnad the reply and if I feel it is relevent to me then why should I spend my time to re-frase my question.

Thanks for that, I very well read the reply. But havent got anything out of that. So trying to re-ask my question in more detailed to get an answer.

Dude!! how many times you ask the question, the answer will be the same!!

NO if your wife wants to move from T1 to T1 dependent she will have to file the application from your home country.... U cannot switch from T1 to T1 Dependent in country....

Hello Boardmembers

Sorry for reopening the closed thread. I have a related query;
I am holding Tier1 visa and eligible for ILR in May 2012. My wife also holds Tier1 visa which is expiring by end of this year.

For having herself as dependent on my visa; she would leave the UK by end of this year; apply for entry clearance from India on Tier1 depedent category and come to the UK in beginning of next year once visa is obtained.

Can you please let me know
Will I be eligible to apply for ILR in May 12 along with my wife who would gave obtained entry clearance merely three months back? By that time we would have completed together stay period of three years and three months. Three years when she had leave to remain as Tier 1 visa holder and three montsh when she had leave to remain as Tier 1 visa holder's dependent.

after calling home office today, it seems that it is not possible.
As the two years of together stay is applicable only if the spouse has stayed together on dependent category. In my case, my spouse had been staying together but with her own indenpendent Tier1 visa so even though she leaves the country and comes back to join me, I won't be able to include her on my ILR application.
