HSMP judicial review for settelment

my story:

I received my HSMP visa in 2006 and entered in UK in Jan 2007 but left shortly UK because of changing rules. When I was in my own country I found about HSMP judicial review and therefore I applied for re-entering UK through Tier 1 general before related deadline and was granted a three year which is going to expire in May 2012. I believe based on Judicial review policy document released on July 2008. I believe, my staying outside UK will be counted toward qualification for Settlement. In other word based on my arrival with my previous HSMP in Jan 2007 I must be qualified for settlement in Jan 2012.

Does anyone direct me if my interpretation is right and will I be able to apply for settlement based on description above.
