Post by kj29 » Tue Nov 08, 2011 9:01 pm

Hi All,
I hope someone will help me to guide me with a situation I hope no one ever goes through
My father came to visit me in UK in 2009 and through his stay our circumstances changed and we applied for indefinate remain to leave his application is still pending and last week he had major stem brain stroke and is completely bedl ridden, paralysed on one side completely and is not even able to look after himself at all cant even talk luckily he is out of danger now but will need lomg term care and will be on medication for rest of his life
my questions are
can anything be done to resolve his immigration status

secondly my solictior told me whilst he is waiting for his application to be processed he is entitled to nhs care hence he is registered with nhs is this right or l will have to pay

will he be entitled to care in community
please help thanks our world has turned upside down overnight

The solicitor may be incorrect. If your father made a valid application, then his visitor leave continues under section 3C. Therefore, unfortunately, he may not be entitled to free NHS care, except for emergency treatment in a hospital's accident and emergency department.
