HMRC Issue - will I Qualify for ILR ???

Post by ilraspirant » Sat Nov 12, 2011 10:18 pm

Hello All,

I am very worried, please could anyone advice me, here is my situation:

Yesterday I rang up HMRC to request for Employment history from 2007 to till now. Surprisingly I was told that I have not filed my SELF ASSESSMENT from 2007-08, 2008-09, 2009-10, and I was "very strongly" asked to file them immediately and they told me that they are posting document immediately. (They said they have been posting them from last 3 years, but I never ever received them ... :(

I have read on few news articles about not filing HMRC SELF ASSESSMENT's and understood that I may have to pay around £££ 1400-2000 for above mentioned 3 financial years.

Now my worry is, WILL THE ABOVE ISSUE Disqualify me from applying from ILR due in August 2012 ???

Please kindly throw somelight and help me understand my situation.... as dont have much knowledge in immigration or financial fields..... :( :( :(

Are you employed or self-employed or both?
Do you pay taxes through PAYE?

Hi Sushdmehta,

Thanks, details below.....

From 2007 to till now, I had only ONE SOURCE of Income and paid taxes thru PAYE.( I never had or owned any company on my own, but has gone thru a Umbrella Company for all paytoll and tax payments it is them who issued P45's).

I have all relevant P45's and P60's from 2007 to tii date + all bank statements + all paysips....fully attested by relevant employers.....

Last 3 months In financial year 2007-2008 + first 3 months in financial year 2008-2009, I worked as a consultant and from there I am working as a permanent employee of the company.

Its the companies that I worked for have deducted taxes...

Please kindly advice me where I stand......

If you have always paid tax through PAYE and have never been self-employed and have had no other source of income but from one employment, then why is HMRC suggesting that you have to submit self-assessment ... and that too for the past 3 years?

A case of mistaken identity? Or a dodgy employer evading tax?

If you've been paying taxes through PAYE with your employer, it is your employer's responsibility to ensure that any tax you are liable to pay is deducted at source ... not yours! But to ensure that you are not at the receiving end of it all when you apply for settlement, you should get to the bottom of this as soon as you can.

Hi Sushdmehta,

Many Thanks.

I will exactly do the same and if I find any issue with employer like correct tax not being paid, I will explain that to HMRC by visiting their local office here.

But my query is, will this effect my ILR? Will I face any issue? Will UKBA take it seriously ?

Where do I stand? please kindly advice.
