Tier 1 General Extension Doubts - Query before proceeding

Post by Sebasam » Fri Nov 18, 2011 2:32 pm

Dear All,
I have been going through this forum long time and it is very useful for the immigrants. I would like to clear all my Tier 1 general Visa doubts and questions from the experts and their experience through here. Can anyone help on this?

1) If we apply 3 months exactly before the current Tier 1 general visa expires, do we get the new extension starting from the current visa date expiry or the date they stamp the visa?
if they give the new visa from the date they stamp, there may be short fall of 2-3months overlapping. I want to avoid that overlapping.

2) If we apply the 2nd time the extension(Provided already got 3+2 years) do we get Visa extension for 1 year or 2 year or 3 years? How many times can we extend Tier 1 general visa?

3) If I apply through PEO office, the same day will I get all my visa approvals as well as Bio metric done the same day?

4) What is the process for Visa extension in postal? for completing visa approval and Bio Metric process?

5) Howlong the passport should be min valid while applying Tier 1 general visa extension?

Thanks,
Sam

1) If you apply earlier than one month before the expiry of you current leave, you will likely create a gap. The guidance is very clear on this.

45. We encourage applications to be made at least a month before the applicant’s extant (still existing) leave expires. Applicants should note however that if the application is made significantly earlier than one month before the expiry of their leave, there is a risk of a shortfall in the required period of leave should they subsequently make an application for settlement. This is because any further leave to remain (for example Indefinite Leave to Remain or Settlement) is granted from the date that we make the decision, not the date the applicant’s extant leave expires

2) For 3 years and you can extend this as many times as you wish

3) That's possible unless the application is flawed and not straightforward, in which case they will send you the decision by post.

4) http://www.ukba.homeoffice.gov.uk/about ... biometric/

5) There is no threshold; it has to be current at the time of the decision to grant leave.

Thanks Luca. It helps a lot. Also, my ILR is pending early next week. However, I have a gap of almost 10months in my previous 5 years living in the UK..but that 10 months is not due to business trip and my personal visit out of UK. Can I give a try for ILR if not, I have to start my Tier 1 general extensions...

Thanks
