tier dependent

Hi
Can I apply for dependent visa for my child who born in UK in June 2011 and currently in India. I am studying level 6 course in a college which is A rated and I applied for tier 4 in June 2011 and my wife is dependent on me. Please
help, as I read in the forum, it says Tier 4 category can not bring dependants unless they are studying in HEI. thank you

Did your child have PBS dependent leave before leaving the UK?

Your child does not qualify as a PBS dependent because you are not studying at post graduate level at an HEI and presumably not govt sponsored.

However your child should qualify for entry clearance under 305-309 of the Immigration Rules

You should seek legal advice on this application,

thank you. the immigration rule 305 you mentioned says they will give visa for a child if both parents are in UK with valid visa. So under which category I have to apply. The immigration rule 305 applies to which tier system. please inform. thank you

If its not a part of tier system, then which application I have to use, how to apply. How to find solicitor who does this. please help

I will get PR on long residency basis in 8 months time, so suggest me which one to go for please

I applied for tier 4 visa before 4th july 2011, still new rules apply to me while applying for dependent visa for my child, as my wife got dependent visa on me.

your wife qualified because she had current leave as your tier 4 dependent/as a student dependent and applied at the same time as you. Your child does not qualify under 319H

The policy guidance and Appendix E of the immigration rules explain the requirement(s) - the only sources of accurate information.
