Hi

Can anyone please advise if someone spends 1 and half in UK under

Working holiday maker and then moved on the TIER 1 genreal migarnt and has spent 3 and half yrs will the quailify for PR ??

In total thats 5 years

Hi

My wife is planning to head to india for 7 months due to pregnancy.

She is on dependent visa tier 1 genreal . Her visa expires May 2012.

Should i get a another extension when her visa expires and then later after 2 yrs of continous stay apply for a ILR.

or is this possible or will i have a problem

She has not spent 2 yrs in the UK. But when she comes back she is probably will spend 2 yrs of continous stay

well you wife is your dependant.
So it does not really matter where she is or when i

You need as main applicant to be here for 5 years. , date to date.

when you get ur indefinite leave after 5 yrs, she can be ur dependant

it's u that counts , not her

1. Extension cannot be applied for from outside the UK.
2. If your wife is outside UK when her current leave expires, she will need to apply for entry clearance as a dependant of PBS migrant.

Hi Mr Mehta

You have told me in the past that i can apply for my extension here in the Uk and send the docs over to my wife in india so she can apply for her extension before her visa expires.

Both of our visas expire on May 21 2012

If u do a peo on Mar 28 2012 and get the visa and Fed ex it her before May 20 2012 can she still apply in india.

She cannot extend from India, but she will need to apply for new Entry Clearance. She will need to satisfy the dependant requirements as set out in the Dependants' Policy Guidance which you can find on the UKBA website. So whether you send her the documents before or after the 20th of May 2012, it will not make a difference, she will still be required to apply for Entry Clearance if her current visa expires while she is outside the UK.

Hi Experts

Can you please clarify.

I am on TIER 1 migrant genreal due to go for extension in Apr 2012.

My wife is going back to india in a couple of months and will be only back after 8 months due to pregnancy i was been told by a expert that when she is india after her visa expires she will have get a new entry clearance .

Important question is will i have any problem here when i submit for my extension.( stand alone ) will they not ask why are you not applying for dependant . and in the future for my ILR will i have any issues

I am very nervous please post .
