What visa for my wife?

Post by vb3d79 » Thu Dec 01, 2011 8:06 pm

Hi all,

I am getting married soon to this girl who lives abroad and has to get a visa to come to UK.
I have British passport, and I am living and working in the UK as a British citizen.
I don't know what visa she should apply for.
First, I was told about the settlement visa, but there are two reasons why we won't consider it
1 - We are planning to move to her country after couple/few years.
2 - She does't speak English very good, and I believe this type of visa needs an English test, so she would probably get refused.

And I checked the family visit visa, but few things are not clear:
1 - I am not sure if my wife can apply as a family member because there is another type for partners.
2 - On one page, it says that visit visa are for visits that for 6 months maximum, but when I start the on-line application, there are choices of different visit visas, that goes for 6 months, 1yr, 2yrs, 5yrs and 10 years.
Won't they refuse the application if she applys for a visit visa for 2 years?

Other two things:

- On the UKAB, there is a page that mentions a non-settlement visa, that is not EEA family member, what could it be?

- At the UKAB website, there is a mention of a partner/spouse visa, but I can't find it on the on-line application.
There are only
- Visit
- Study
- Work
- Settelment
- Transit
- Other
- Exempt

Sorry for the long message, just to make my situation clear

Thanks in advance

You need a spouse visa for your wife.

Read this link for the requirements you have to meet
http://www.ukba.homeoffice.gov.uk/polic ... /set/set3/

Here are the forms you will need
http://www.ukba.homeoffice.gov.uk/visas ... utside-uk/

Hope this helps

Thanks!
But I can't find the forms in the link you put.
Anyway, she have to apply online, where she lives they don't accept forms anymore, they only accept online applications.

And as I mentioned, there is no spouse visa in the online application

so what visa?

Settlement - sub type Spouse.

And just to clarify on the family visit visa - the longer visas are merely for convenience - you can still only stay 6 months in any 12 and she won't be able to work, study etc here. They are there so that you don't (if a regular visitor) have to keep re-applying.

She'll have to prove she has strong ties to her home country and will return at the end of each visit. Not an easy thing to do with a husband in the UK.
