ILR Due & Job change

Post by ILRDUE » Sun Dec 04, 2011 9:17 am

Hi,

I am not Tier1-G and my ILR falling in Feb, planning to apply by Jan
end but last week I have a better job offer which I really do not want to
miss, but considering my present job requires 4 weeks of notice period,
I would seek an expert advice from moderators which option should
I take out of below,

(1) If I resign now, I can start new job by mid-Jan which is the time I am
applying for my ILR, will this then affect my ILR application? Assuming
my all pay slips are from my old existing employer, also do I need to
disclose anything about my new job then? In any case what happens
if they call my old employer for any sort of varification?

(2) I wait until Jan end to resign (But this seems unlikely since my job
offer can't wait until Jan end + 4 weeks notice period means Feb end)

An early response will be appreciated

Thanks

Two things needed from Employers for ILR are

1. Salary Slips - You are okay here as you need 12 months salary slips out of the 15 month period.

2. Employment Letter - This could be tricky as you need a letter confirming employment and saying you are needed for the foreseeable future.

What about applying after getting the first salary from the next employer?. This way you can get the letter from them as well.

I saw a person who had three jobs in the qualifying period, but they had no issues with it.

ILR Due & Job Change

Thanks Sree_Nair

I appreciate your response, however is it mandatory requirement to
have current employment letter?

I remember submitting my intial contract along with payslips + bank statements and also all P60s when I renewed to Tier1G

I do have all these things ready but what I can't do is, to ask my new
employer to wait until Feb End (obviously they won't) assuming my ILR due in Jan end and then resign with 4 weeks notice period.

Do you think without existing employer letter there should be any issue?

OR I can include this matter in my cover letter and then submit my new job offer letter along with.

Thanks

Tier G , not important to have a letter from employer.

Get your new employer to write you a letter saying that you are required by them for forseeable future. don't miss out on good opportunity to progress.

your previous employer is legally bound to give you your payslips and p60 so i wouldn't worry about it.

perhaps, try to speak to current employer to see if you can end in good terms.
