Urgent- Cohabitation-Wife's document for ILR??

Post by Yogiyogi » Mon Dec 05, 2011 10:40 am

My wife is applying as dependent with me for ILR -SET(O).

Questions
1) For many days wife should not be out of UK and in last how many years? Is it 2 years or 5 years?
2) My wife was stuck in india for around 20 days due iceland volcanic ash in 2010. What document should be attached to prove that flights was not available that time?

Her name is not available on any utility bills. So I have decided to attached below list with application. Please let me know is it sufficient?

1)HSBC bank statement for 2 years showing residential address- Joint account of my and wife
2)Payslip of wife's for last 2 years
3)wife's P60 form for year 2008-2009 and 2009-2010 showing residential address
4)wife's P40 form for year 2010-2011 provided by HMRC as replacement for P60 showing residential address
5)Letter from wife's employer showing employment and residential address
6)Marriage certificate

that should be enough.
I dont think absence from UK applies to dependent. As long as she was living with you from the last time u were granted a leave to remain , you should be fine.

For the first two questions,

Your Dependants absence from UK doesn't matter at all. Only thing that matters is that they had been your dependent (has a Dependent Visa) for more than 2 years. So you won't even need to mention her absence anywhere in the form or supporting documents.

On the Co-Habitation documents, The ones you have mentioned should be
more than enough.
