visa refused, saddened by ripping apart of our family

Post by krg1180 » Mon Nov 28, 2011 10:53 pm

Hi everyone.
My husbands visa application has been refused and I'm so upset about the decision. We have been together for 7 years, married for 4 we have a 2 year old son. We lived in the UK for the first 2 years of our marriage on a marriage visa, he was in the British Army prior to the marriage visa.
We moved overseas to live in his home country but unfortunately it did'nt work out and I wanted to move back to the UK. When we arrived in the UK we found out he had to apply for his visa from his home country, I couldn't face going back there so my husband went back on his own. We have been living in different countries for almost 6 months now, its so tough with out him especially being sole parent for our son.
My husbands visa application was denied today, I have no idea why until the paper work comes through. I thought it would be a straight forward application and had no cause to think it would be denied.

We are going to appeal but I don't know what to add to our application to make it successful until I know why they denied him.
I'm shocked and saddened at this decision.

Post the reason for refusal when you have it. It could be something simple and easily rectified without going to appeal.

My husband got the paperwork back today and it states that the visa was refused because we gave no proof of my mums ownership of her house (I am currently staying with her and my husband will to when he gets his visa), nor the amount of bedrooms.
Our funding is an issue aswell, we haven't provided proof of enough funds to support us without recourse to public funds and even though my husband states he is looking for work there is no guarantee how long that will take.

My mum can supply us with the relevant paperwork - mortgage statement and bank statement but its the financial side that is concerning us.
I am currently at home with our 2 year old son, my husband is going to get full time employment when he gets here, we understand the current job climate but are certain he will get some sort of work.
I gave them proof of our savings which is £1000 but we don't have anything other than this, I am currently getting income support due to my husband being overseas.

We are a little stuck on how to proceed, should he try and contact his old company in the uk and see if they will write a job interview letter, saying they will give him an interview at least. Do you think this would help?

My husband doesn't have any savings where he is and all we have is my savings in the UK.

You'll need to show that you will have a minimum of £105.95 remaining weekly for you and your husband + £63.00 for your child after paying any contribution for rent or council tax and any loan repayments. The ECO will want to see a written job offer...an interview isn't likely to be sufficient with no current income and only £1,000 in savings.
Would anyone in the family be in a position to provide 3rd party financial support?
If you can satisfy the reasons for refusal, you should consider re-applying rather than going to appeal. The ECO made the decision under the Regulations on the evidence you submitted with your application. New evidence not made available to the ECO in the original application may not be taken into consideration at an appeal.
