10 year long residency advise me

I came as a student in 2002 1st september and after all the extension now i am on tier 1 general which is for two years and it will finish in 2013 april my 10 years will complete in 2012 1st of september been out of the country three times first one 1 month second time 7 days and third time 1 month and then i recently married to the girl who was student here and then she became my tier 1 dependant.I have already passed my life in the uk test .
i give you a little recap .
came 1st of sept student visa and after all extensions student till 31st march 2009
than psw which till march 2011 and then tier 1 general till 2013 april.
Now i would like to apply for ILR 10 years rule
QUESTIONS
.After hearing all the story do you think i need to do anything?
.Does my wife needs to do LIUK?
.What visa she will get indefinite or anyother?
.What documents we need to produce to ukba please tell us in detail?
.How early can i Apply ?
.i got 6 fixed penalty points which i got two times and which homeoffice already know coz when i done tier 1 general extension i send my driving license to show that i got points?
.and i heared they are bring biometrics in 2012 march for every immigration category so it mean if i get my ILR it will be on a card?
Please advise and guide me do i need to do anything different shall i pply myself or go through solicitor.

1. After reading your complete history, your first question is a bit confusing. You have to decide what you have to do. You want to apply for ILR after Tier 1 5 years or your want to apply for 10 year long residence visa.

2. Your wife needs life in the UK test at the time of her settlement. The LIUK is now mandatory requirments for spouses of PBS and settled persons.

3. She does not qualify for ILR, as you have told that you have recently married her. She need to complete 2 years as your dependent for Tier 1 General. She is not allowed to convert to ILR using your 10 years. The only choice is either you wait for your Tier 1 to be completed in 2013 and she apply with you as Tier 1 dependent. OR you can get your ILR and then she can convert to spouse of setttled person using Form FLR(M).

4. I can't tell you this. Every form has its own requirments. Decide first which route you want to go. Then read the instructions from UKBA guidelines. If you find any problem, you can contact the forum for that.

5. 28 Days before your 10 years completion (in case of 10 Year residency). 28 days before your 5 years on Tier 1 General.

6. You need not to send your Driving Licence. Just mentioned them in your application form, as you have done it first time. It will not effect your ILR.

7. It is just a news...What difference does it make. Visa on passport or Biometric card.

Your choice of applying self or immigration advisor. If you feel you can handle it, then do it yourself. O/W use Immigraton Advisior.
