SET(O) Form - question about the tenancy

Hi all,

I will be applying soon for ILR based on 5 years 'old' WP and have a question regarding Section 5 - Your Home and Finances in SET(O) form.

I am in doubt how to answer questions 5.1 and 5.2.

I've been living with my girlfriend since 2010 in a flat she's renting from a local council as NHS key worker. Our local council has a scheme that provides sub-market rents for key workers. When she applied for it, she was put on a council housing register. On the application form, she put herself as a main applicant and me as her partner. Only her name appears on the Tenancy Agreement which is between her and a housing developer which is working in partnership with the council. We are sharing the rent, all bills and costs.

Between my arrival to the UK (2007) and 2010 I had been renting house on my own and have those Tenancy Agreements which are on my name. Me and my girlfriend (who is British and UK citizen) have been together since 2008 and in 2010 we decided to start living together.

Question 5.1 says: Is your home in the UK
a) owned by you
b) rented from a local authority or housing association by you?
c) privately rented by you
d) owned or rented by a relative or friend
e) other? Give details below.

How shall I answer this question?

I am thinking to tick option e) and write down that the flat is rented by my girlfriend under the NHS key worker scheme.

Could this potentially be a problem? Would case worker think that I am claiming benefits? Shall I bring Tenancy Agreement (although my name is not on it)?

Question 5.2: Do you or your partner, or both, pay any rent or mortgage for your home? If so, how much do you pay each month?

Shall I put the total monthly rent or just my part - which is half of it?

5.1. Tick "e" and fill in the details you have mentioned.

5.3 This is the total monthly rent payable to the authority. This will be sum of your share and her share in rent only. If the rent includes any bills then include that as well. However, this is the final amont you pay to your landlord.
The question is... to be or not to be....
