Working Visa for my brother

Post by John G » Tue Dec 13, 2011 2:01 pm

Hi All,

I had a quick question re Tier 5 Youth Mobility Scheme visa for my brother.

He is 24, Australian.

I looked into the process and it appears he has to be in Australia to place this application and do the biometric's. This is a problem, as he currently has a Round the World ticket and is in Argentina!

My question is two fold:

1) Can he apply for this visa whilst in the UK?

If not, then

2) Can he apply for this visa whilst in Argentina?

If the answer is no to both of the above, then does anyone know what Visa he can apply for to work in the UK?

Thanks

John

1. No
2. No
Then, for the last part it's confusing. Are you asking what visa he can apply for that will allow him to work in the UK, or what visa he can apply for from inside the UK that will allow him to work?

Where to apply? - the policy

Yes, what visa he can apply for from inside the UK that will allow him to work?

I should also mention, I am a dual Australian/Italian national, so not sure if he would potentially fall under Family EEA treaty rights?

Thanks

John

He can't make any applications from inside the UK from the position of a visitor.

OK, are there any visa's he can apply for from South America? are there any EU treaty rights given he is my brother?

He is currently in South America for a few months and will be mainly in Argentina, so could apply via the embassy/consulate there.

He isn't the most organised kid and thus the reason he didn't complete the Tier 5 application whilst in Australia! :x

Eu rights hinge on dependence and clearly he is not. Options from Oz only are the PBS Tier 1 categories (except general), Tier 2 and Tier 5. He can't apply for these in South America.
