Partner Visa for girlfriend, QQ about Maintenance rules

Post by gregbrowning » Sat Dec 17, 2011 11:14 am

Dear all,

Thanks in advance for anyone who can help me.

Situation:
I am a UK citizen, and my partner is Russian. We have been together for just over 2 years. We will be applying for unmarried partner visa with the intention of both living in the UK. Although If it helps, we are happy to get married and apply for a Wife Visa.

My main problem is to do with employment and maintenance. Over the last 2 years, we have spent the majority of it travelling, although have worked full time in Australia for a period of 6 months, of which the Australian bank accounts will show the income. For the last 4 months we have been living in Russia and I have been teaching English, I am able to get a letter from my employer proving my work here, but I have been paid cash-in-hand, as is the way here.

Therefore if I show my UK bank statements for the last 2 years, there will be no incomings or outgoings, as I did not use it.

Questions:

If I will be unemployed at the time of application will this affect the result?
What if my parents agree to pay any expenses for both of us and act as a guarantee? will this be sufficient?
If I show my bank statements and am unable to show proof of work in the UK for the last 2 years will this be a problem?

Many thanks again,

Greg

If I will be unemployed at the time of application will this affect the result? Employment is not a mandatory requirement; having access to adequate financial resources is a requirement.

What if my parents agree to pay any expenses for both of us and act as a guarantee? will this be sufficient? Yes.

If I show my bank statements and am unable to show proof of work in the UK for the last 2 years will this be a problem? Your UK bank statements are not relevant if they don't show adequate financial resources.

Unless you intend to work remotely (teleworker) the UKBA will assume that any work you have now, in your current location, will cease (and the income from it) when you relocate to the UK.

You make no mention of your evidence to prove an interpersonal relationship akin to marriage. Have you been living together throughout the two year period and do you have a paper-trail of official documents such as bills and letters that can show this?

Thank you Lucapooka for the quick reply.

Yes, we've been living together for the last 2 years. Although our paper trail is a little thin on the ground. We have letters addressed to both of us separately to an address we lived at in Australia. We have numerous photos of the whole time we've been together. For the time we spent travelling, we have the same entry/exit stamps. We worked for the same employer in Australia for 5 months and have payslips addressed to each of us.

Not sure if it helps, but my parents have met my girlfriend and I am able to prove it with photos. We also have a lot of email/sms correspondence between us and also emails addressed to both of us from joint friends.

In your opinion do you think this would be sufficient?

My father earns around 60k pounds a year and owns his own house. Plus has extra money in savings.

My girlfriend speaks fluent English.

Thanks.
